Sunday 2nd I attended Circle meeting at 9 oclock A.M. and general meeting at 2 P.M. Monday 3 Writing. The B.Y. Academy opened its last term of the Eleveneth year of that Institution, with an increa- sed attendance Tuesday 4 Engagued with Tabernacle books, In the evening attended regular Priesthood meeting. The propriety of grading the Tabernacle ground came up an was refered to committee. Wednesday 5 In the afternoon Bishop J.P.R. John- son an myself drove to Pleasant Grove ----- new page (MSSSC1946_p006.jpg) for the purpose of laboring in the interest of the Stake Tabernacle as that ward is far behind on their apportionment. We stoped with Elder David Adamson the Miller Thursday 6 Bishop Johnson returned to Provo to attend Fast meeting and came back in the evening. Bishop John Brown and Councilors met with us in the evening and we decided to hold a public meeting next Thursday in Pleasent Grove. We impressed the Bishop and his Counselors with the importance of the Ward making immediate settlement of the balance due on the original apportionme- nt to the ward Friday 7 In the afternoon we returned to Provo. Took supper with Emily Saturday 8 Attended Theatre Board meeting and staid all night at the Tabernacle in order to be near meetings ----- new page (MSSSC1946_p007.jpg) thereby be enabled to attend worship and council meetings without exposure to U.S. Marshals on the streets. I have persued this course for some time, and at night I visit my folks spending a few hours with them receiving the inthusiasm joy and delight of my dear little children who cling to me and when I think of taking my departure, they weep- ingly cling to me and say "Don't go stay with us" "Oh! Papa don't go" Sunday 9. I am 51 years old to day. I attended Circle meeting 9 A.M. and at 2 P.M. general meeting which was addressed by Elders Rich and Crowley Monday 10 Writing. Evening attended the Theatre occupying, of course a "reserved locality" Tuesday 11 The election of Directors of the Bank took place to day and Director ----- new page (MSSSC1946_p008.jpg) for the Provo Theatre Co in the evening. I ve elected a director of the Bank and President of the Theatre Co Wednesday 12 "The Rio Grande" was played in Provo Theatre At 5.20 o clock this day The "Edmonds TuckerBill." passed the House with a whoop and a howl. Thursday 13 In consequence of the indisposition of myself and Bishop Johnson and the extreemly stormy day we postpon the meeting at Pleasent Grove, but in the limited time between receiving the letter and hour of meeting, the notice could not be extensively circulated and hence the meeting house was crowded, notwithstanding the stormey weather Friday 14 Still prepairing Financial Statement of the Tabernacle from its begining in 1883 to the close of 1886. ----- new page (MSSSC1946_p009.jpg) Saturday 15 I attended the Stake Priesthood meeting the attendence being greater than usual Sunday 16. Thursday 20 In the afternoon went to American Fork in Bp Johnsons team, he going by Utah Central. R.R. We attended a meeting and introduced our Sub- jict of Tabernacle, a splended feeling prevailed. The Habus Corpus case of Lorenzo Snow heard before the Supreme Court of the United States to day, In this case important rulings of the Utah Courts are involved especially the segregation of indictment for the ----- new page (MSSSC1946_p010.jpg) same offence. The ruling of the partizen Courts of Utah in cohabitation case led the Grand Juries to bring in indictments with 2 to 6 courts for the same of offence. These extra-judicial-Legislative and judicial courts ruled that a man could be indicted for every day in the year, thus giving a man Credit for more Vitality than he really posesses unless he be of the goat-specie Friday 21. According to appointment Bishop Johnson and mysef meet quite a number of the Priesthood in the City Hall to further devise the best plan of making Coll- ections to liquidate the $2000 balance which the ward owes on the Tabernacle The results of the meeting was that the various quorums get togeather and appoint a committee to canvass the Ward. Returned to Provo Saturday 22. Writing ----- new page (MSSSC1946_p011.jpg) Sunday 23 Attended Circle and afternoon meetings Monday 24 Book-keeping. Tuesday 25 Evening attended Theatre Board meeting Wednesday 26, Attending to my books and otherwise en- gaged. Thursday 27 Writing as usual in my books Friday 28 Pres Smoot and Bishop John Brown called on me. In the evening went to see Sarah, remaining some 3 hours and when ready to leave she accused me of being guilty of the most beastly trik that any man could perpitrate in himself, but I thank God for my inosency in that crime. The slander was most outrageous, but she plead, upon her Knees, for me to forgive her which of course I did on her promicing never to comit herself in that way again. ----- new page (MSSSC1946_p012.jpg) Saturday 29 Settling with S. Friday 4 In the evening attended Theatre Board meeting. Vice-President J.P.R. Johnson tendered his resgnation pending its consideration adjourned until tomorrow 2 P.M. Saturday 5 Attended Stake Priesthood meeting and presented my report of the funds received and disbursed on Stake Tabernacle and asked that a committee be app ointed to audit the same whereupon the President appointed Bp John E Booth and John R Twelves. President Smoot advised the Bishops with their Counselors to visit the people at their homes and labor to effect a reform among the Saints. The line of demarcation should be more visibly drawn between the Saints and sinners. The tears ----- new page (MSSSC1946_p014.jpg) gentiles- are being banded togeather as spoken of the parable of the wheat and tears. as shown forth in the various combinations thro- ghout the land. Here in Utah has been organized the "Loyal League" a sort of "cut throat" organization sworn to uproot Mormonism and demolish the order of the Priesthood. Belonging to this "Loyal League" we find the professed ministers of the Gospel urging on the combination that would delight to see the Saints distroyed. A resort to the use of the musket and sword, to ac- complish this object, has been advocated in their secret cou- ncils. All the bitter apostates throughout the land are banded togeather under this head. During last night I called the quarintine Physician up to see my little daughter Birdie who had the appearence of coming ----- new page (MSSSC1946_p015.jpg) down with the dyphtheria. It only proved to be the sore throat. I sat up with her all night Sunday 6 At 9 AM attended Circle meeting and at 2 P.M. general meeting Monday 7 The Supreme Court to day rendered a decision in Lorenzo Snow's case reversing the decision of the Supreme Court of the Territory. This may be recorded as the greatest victory to our people ever won through any act on the part of government to- wards us. Apostle Snow is not only liberated from prison but many others of our brethren and all indict- ments exceeding one now out against Apostles Prophets and Elders are made null and void, thus checking the seggregation bu- siness so Tenacitly held on to by the Courts of Utah. The defeat of our enemies is remarkable sore and galling to them and their only ----- new page (MSSSC1946_p016.jpg) consoling thought is that Congress will pass the EdmondsTucker Bill, which is now being consider by a conference committee of both houses, In the evening many Citizens of Provo collected material and built a bonfire near the Court House and made speeches of rejoicing Tuesday 8. The gentiles are galling under their defeat. Evening attended High Council meeting Wednesday 9 I am not so careful in hiding since the segregation has been abolished as I do not fear one court or imprisonment for six months Thursday 10 A death in Tuckers family forced him to abandon his post as chairman of the Conference Committee from the House thus reducing the sting which he possessed, and by which ----- new page (MSSSC1946_p017.jpg) the bill was rushed through with a whoop and a yell. A, Mr Hammond was chosen to fill his place, in the Committee. Friday 11 The Conference Committee were to decide on the bill and report to day By telegrames we learn that many of the Venimous points are strick- en out, greatly modifying the bill. These modifications are shivering the "timbers" of the "Loyal Lague" Saturday 12 Great anxiety prevails over the tardiness of the Committee in report- ing. Sunday 13 Attended Circle Meeting 9 A M and general meeting at 2 P.M. I also was at the funeral services over the remains of Sister Scott a widow of the late Bishop Scott of the Second Ward. ----- new page (MSSSC1946_p018.jpg) Monday 14. Tuesday 15. In the evening attended Priesthood Meeting. Pres A. O Smoot. D John and myself spoke on tithing matters. Some $7.000 less tiths than 1885 is shown in the reports for 1886, and about 500 less thiths payers Wednesday 16. Bishops and myself reviewing Tabernacle book to find a little discripency in the trial balancer. In the evening I moved to new quarters to John G. Jones, as it was thought best for me to Keep out of the way for the present at least. My quarters at the Tabernacle were Known pretty generally especially by many of our people, and deputies had been heard to say that my hiding place was Known by them, altho I had been on the street more or less but when they began to manifest their intentions the more anxious I was ----- new page (MSSSC1946_p022.jpg) that they should not find me. Thursday 17 The "Edmonds Tucker Bill" as it came from the Conference Committee passed the House by a vote of 202, against 39 nos. In the evening I called on Sarah and received a flood of abuse, and when I started to go she snatched my cap and threw it with one of my overshoes in the bed room, and placed herself against the door, finially I succeeded in getting my boy to go in and get them, after forcing her from the door, I was somewhat late in getting to the High Council The Case of Richard Breartin Sr. came up reported from the 45 q[---] of the Seventies. He was droped from said quorum and the High Council in taking action on his case Cut him off from the Church. After hearing the case the President witheld his decision until he could visit the Benjamin Ward The Senate passed the Edmonds Tucker bill Saturday 19. In view of the Court convening in Provo Monday next and the intense fear Emily has of appearing before a Grand Jury, she resolved of her now choise to go into hiding, rather than be a witness against be, prefering that if I should be indicted, it be on some ones else testimony. In visiting Sarah she felt somewhat undecided. I told her ----- new page (MSSSC1946_p024.jpg) to freely act her own pleasure Sunday 20 I attended Circle in the morning and general meeting in the afternoon The speakers were Patriarch Colton and Bp. John .E. Booth I spent the evening with Emily Monday 21. United States district Court for the First Judicial District opened to day. In the evening visited Sarah who decides to go off for a while Tuesday 22 This being a National Holy day the Court adjourned. The High Council met in the evening to hear the case of Beddoros verse Eavens appealed from Bishops Court of Salem. The matter have been heard by the Bp. before any investigation on the part of the Teachers. it was refered back to first come before the teachers for settlement if possible and if in case they fail to effect proper recon- ciliation, then let the Bishop try the ----- new page (MSSSC1946_p025.jpg) it and render a decision. In the evening Sarah returned home Wednesday 23, In the evening I arranged to have Sarah stop at bro Geo Meldrums. I attended High Council. The case of Dr R.M. Rogers for an attempt to commit incest was set for trial, he failing to appear, A communication from Rogers stated that he was at Draper and in consequence of sickness could not be present, but asked the Council to defer the investigation to any time that would suit their convenience and give him as much time as possible and he would indeavour to be present. The President ruled that the case could go on. At the conclusion of the evidence and the speeches on both sides, the President asked me to express my views in the matter whereupon I stated that while I was fully convinced that the Dr. was guilty I would prefer to give him a chance to defend himself ----- new page (MSSSC1946_p026.jpg) before the Council in as much as he had made the request and no special advantage could be taken to prejudice the testimony already given. Councilors Isaac Bullock, J.E. Tulmage (speaker for the Dr.) and Geo M. Broon concu- red with me but the President gave us a regular scoring for wishing to occupy the attention of the Council any more on the case. Rogers was cut off from the Church of Jesus Christ of Latter day Saints by descision of the President sanction by the Council. Word reached me that the Grand Jury would at once attempt to handle my case. Thursday 24 By the request of my cousin Eva Bunker of Durham N.H. Evening attended Priesthood meeting Wednesday 2. Spent the evening at the Theatre arranging for the Choir Benefit Thursday 3 The ten days in which the President has to sign bills or veto expires to night at 12 o clock on the Edmond Tucker bill. Should he fail to sign or veto it before that hour it then becomes law without his signature Great anxiety was fet throughout the day by all parties. Through an agent in Washington the leaders of the Church were given to under- stand that if the people of Utah or the Mormon comunity, would con- sent to a State constitution inclu- ding an anti polygamy clause, the President would return the bill and recommend the Scott. ----- new page (MSSSC1946_p030.jpg) amendment offered in the House giving the people 6 month to prepair such a constitution and ratify it, which if they faild to do then the law would go into effect at the expiration of that time. This matter was discused and consented to and the results dis- patched to Washington. The President failing in his promise to return the bill and allowing it to become law, is supposed to be the result of a weakening of the spinal colume. Late at night it was learned by dispatch from Washington, that the bill became law without the signature of the President. The Know Nothing Loyal League made an attempt to rejoice but there were so many of their fon- dest and most disirable points cut out of the bill, that their rejoicing was a struggle and a mournful effort. ----- new page (MSSSC1946_p031.jpg) The Primary Association Conference commenced to day at 10 A.M. and at 2 P.M. the Young Ladies met. Provo City Utah March 9th 1884 President John Taylor Dear Brother: I address this letter to you as an explanation of the subject matter in the comm- unication of Elder J. W. Beans, clerk of the High Council of this Stake of the 24 ult, in which my name appears as the mover in the said High Council for aid from the Trustee-in-Trust ----- new page (MSSSC1946_p033.jpg) to the amount of $200.00 for the purpose of purcheasing a sutable desk, records and Stationary, for the use and benefit of the High Council. You say in your reply to Elder Bean's letter that, "It is not a good idea for the authorities of the Church to coun- tinance or encourage a disposition to call for pay from the Church for such purposes as you mention". It is beca- use of this expression that I feel called upon to define my position and offer you an explanation as a justification of my volentary motion in the High Council and if after the real facts are offered, you hold that my action in the High Council was, "not a good idea" and that the Council is not justly entitled to a small amount for the purposes asked for, then I shall certainly acquiese in your decision and govern myself accordingly in the future. I had thoroughly examined into ----- new page (MSSSC1946_p034.jpg) the condition of the records and files of the High Council of this Stake and I truthfully ascert that it is disgraceful to Keep papers and documents belonging to a court of record in the condition that ours are Kept. For years past and up to the present all papers are on file in old soap-boxes and what books we have lying around on tables or on the floor, because the clerk has no desk in which to Keep these things. The clerk of the High Council who is also the Clerk of the tithing office has no sutable place for these things As to stationary stamps &c, we presume the Tithing Office has always met that expense as the Council has had no funds to handle. In relation to recording minutes &c that is unimportant and not pertinant to, altho embraced within the motion. I still feel asured after learning the above. ----- new page (MSSSC1946_p035.jpg) facts, that you will consider favorably my motion and grant the small amount asked for. If I have seemed to manifest too much interest and attach greater importance to the subject them it demanded, under the circumstances I hope you will pardon me and believe one undeviatingly your brother in the gospel H. H. Cluff Wednesday 9. Visited my children in the evening who are not with their mothers Thursday 10. In the afternoon I managed to get to the Bank Building to attend a meeting of the Board of Directors of the Utah Stake Association. President Taylor as Trustee - in Trust has transfered all the Church or tithing property in this Stake over to the Stake Association. It was decided that I go to Salt Lake City and learn all the pariphanalia adoped in the Salt Lake Stake before opening the books as the Board appointed me as the ----- new page (MSSSC1946_p036.jpg) Treasurer. I stade all night at my Nephews J.W. Cluff so as to be near the Coal station about a quarter of a mile from the depot. Friday 11 Got into the cabuse at the coal- station and went to Salt Lake on the early train. I had inter- views with Bp W B Preston, Angus M Cannon and other, obtaining all the information possible. At night I stoped at bro H.A. Mollys Saturday 12. The papers report a heavy shock of earthquake in Paris France People rushed from dwelling and hotels into the streets. Many build- ings were cracked. Returned on the evening train as far as American Fork for the purpose of running over Su- day to meet President Smoot who will come from Provo in the morning. ----- new page (MSSSC1946_p037.jpg) I stade all night at the Bishops house. He has rooms fit up apart from his family not choosing to live with either wife. His daughters carry his meals to him across the road Sunday 13 President Smoot came on the early train. We wrote the following to Bishop Wm. B. Preston. American Fork March 13th 1887 Bp Wm B Preston Salt Lake City Dear Brother Were the potatoes in the tithing offices of this Stake sold previous to the 2nd of March? if so should they be included in the agents invoice to the Stake or not? I received the following letter from President Taylor in answer to my reply to J. W. Beans letter of the 8th mist. Salt Lake City U.T. March 11th, 1887 Elder H.H. Cluff Provo Dear Brother; ----- new page (MSSSC1946_p039.jpg) In my letter to Brother Bian I had no design to make personal reference to yourself in making any remark which I did, therefore it is not necessary that I should make further explanation upon that point, I still feel however, that an appropriation of this kind ought not to be granted in a case such as you represent. The query arises. How much would a good desk gow towards correcting the extreme carlessness which your discription makes plainly evident has been shown for years, in regard to papers and books belonging to the High Council, lying round in old soapboxes, on tables, or on the floor' " I scarsely think that an appropriation in and of itself would entirely remedy this palpable want of care. It seems that in a large stake like Utah, it ought not to require much influence to have procured a desk in which such papers and records could be kept instead of having them scattered ----- new page (MSSSC1946_p040.jpg) round as you describe. Your experence as a missionary abroad must have taught you that help of this character can be rendered by the Saints without impoverishing them, either in means or in faith. The tendency, of which mention is made in my last, is growing, an is very apparent, an it would not be long, if it were not checked until the Church would not be called upon to do everything, an pay for everything, which result it must be obvious to you, would be deplorable one in view of its effects upon the faith of the people. In the evening I walked out through the City the mind being peculiarly exer- cised in the contemplation of the past and the present. Thirty seven years have elapsed since I came to this, then, barren wilderness, I was only a beardless youth - a mere boy. I have witnessed since that time the erection of almost every house and public building and the growth of every tree, the opening and improving of all streets and & thoroughfares in the City, through the County and into the mountains, and I have performed with pride, in making Provo City the "Garden City" of Utah. But now I am dep- rived the peciable privlage of walking our streets in the day time without the "Bloodhounds of the Government" being after me. And for what purpose? I never had a lawsuit or trial of any Kind either before the Courts of the land or Church, not even an inves- ----- new page (MSSSC1946_p043.jpg) ligation by the Teachers. I have never interfered with my neighbors, in his rights nor with his wife or daughter, or his pro- perty. I can truthfully say that I never insulted a femail or attempted an insult by indeacent advances or offers. Yet my liberty is Jeoperdised becaus I have humbly, in fear before my Maker, obeyed the Command of God in taking to myself wives, who were sealed to me by the Highest Authority on Earth, in a sacred temple of God. My religious convictions have been such, and are still as firm as ever, that to be an instrument in bringing children into the world or in other words, to multiply and replenish the the Earth was one of the greatest privlages secured to man. During the illness of our darling, my wife scarsely tasted of food for 13 day. The anxiety, loss of sleep and abstaining from food, resulted in an almost total wreck constitutionally One year after my return from Europ I went to the Sandwich Islands on a mission taking my wife with the hope that a few years residence in a tropical clime would recuperate her. S. are passing laws to crush the Church and I am being pursuied. I pray that bonds and imprisonment, if such should ever be inflicted upon me will never turn me from the truth or enduce me to abandon my family or in any manner prove an ailian to the the Covenants made before God Saturday 19. I recived a letter from President Joseph. F. Smith dated February 22nd 1887. Oahu Sandwich Islands ----- new page (MSSSC1946_p046.jpg) from which I copy the following "I will briefly review your letter altho at this late date the questions refered to may be a little stale." "It is a sad comment, indeed, upon our great and free (?) government, that instead of protecting and defending it is converted into an engine for the oppression and persecution of many of its best. and wirthiest citizens. But it is two true, that citizens of America who have never been guilty of any crime, who are patriotic and loyal to their hearts core, to their country and to its constitution and all the laws founded therein, have been driven by the merciless hand of oppression, to seek and to find that protection, freedom and immunities from cruel oppression in foreign lands, governed by Kings, and Monarch and some of them deemed benighted and semi-civilized that has been denied them in their own native land; where it is the boast that the government is instituted ----- new page (MSSSC1946_p047.jpg) by the people and for the people, to secure to them their inalienable rights, "life liberty and the pursuit of happiness" and that it derives its "just powers from the consent of the governed' It is sad to Know that these noble words, once so pregnent with happy meaning and virtue, have at length become but an empty meaningless sound, an worse. a delusion and a Snair. That this, once great nation, is hastening on it downward course to distruction seems too plain for denial, for it is sweeping away, not little by little, but almost by one fell swoop, every found- ation stone of its perminancy and safety By and bye the crash will come, for its doom is sealed by its own hands, if it stay not its oppression and wickedness "I wish I could see that the Kingdom of God was progressing as rapidly upward as our government is hastening downward. President Smoot and myself addressed a letter a letter to Bishop Wm B Preston on financial matters as follows. Bishop Wm. B. Preston Dear Brother In view of the recent changes that have been made with the Church finances, wherein certain funds have been transfered by the Trustee-in- Trust, to the Church Association of this Stake and also in consideration of a Bank account of $5,000.00 against our Stake Tabernacle drawing a heavy interest, we are led to ask you and through you President Taylor to approve of the Board of the Church Association of Utah Stake of Zion to appropriate ----- new page (MSSSC1946_p063.jpg) the sume of $10,000.00 to pay off our Bank obligation & also to enable us to go on with the work towards the completion of the Tabernacle. In support of this, to us, reasonable request, we have to suggest for your consideration that the disbursemet of some of said funds in that direction, is in accordance with the Trustee-in-Trust's deed of conveyance & would be a cord of strength in defence of the genuineness of his transfer, in case the government should attempt to illegally force suit for the recovery of property formily held by the Trustee-in-Trust. There is another matter which we desire to introduce for your favorable & early consideration. Some time ago we gave an explanation to President Taylor in writing & we believe verbaly to you, of the situation of the block pur- chased for the New Academy Building showing that the property was deeded to President A.O. Smoot & H. H. Cluff in accordance with the request of President ----- new page (MSSSC1946_p064.jpg) Taylor at the time he appropriated $5,000.00 for the Academy, to be so held awaiting the action of the heirs of President Young concerning the placing of the visitorial power, in the President of the Church and authorizing the disp- osing of real estate held by the Trustee- of the Academy, to the best advantage for the Institution. We also stated a proposition that had been made in the High Council [---]: to organize an Educational Society under the Territorial laws and have the Block, in question, deeded to the Society and then ask the heirs of President Young to transfer the property of the Academy over to said Society but now as education is a part of the duty and privlage vested in the Board as expressed in the Articles of Incorporation of the Church Association of the Stake, we propose by your consent and that of President Taylor to appropriate the amount yet due the Maisons for labor and material, being about $2,000.00 ----- new page (MSSSC1946_p065.jpg) and have the block conveyed to the Stake Association and then ask the heirs of Pres Young to come in and join the interests of the Brigham Young Academy to the Stake, beleiving it much better and more consistant, with Church government and policy than to organize a Special educational society We believe to appropriate the said amount and have the block placed in the Church Ass- ociation would be sanctioned by the entire stake and be the means of encouraging the people of the Stake to go on with the work of further erecting the fine structure so substantially commenced. Our special conference for the purpose of authorizing the Board of the Church Association of the Stake to appropriate the funds now on hand for specific purposes will be held on Tuesday 26th inst We remain your brethren in the Gospel A. H. Cluff ----- new page (MSSSC1946_p070.jpg) Friday 29th. The following is a copey of a letter to Bp W B Preston in answer to ours of the 18th inst from President Taylor. Bp. W B Preston Dear Brother You have forwarded to me a letter under date of the 18th signed by Brothers A. O. Smoot and H. H. Cluff, the first paragraph of which is in relation to property, transfered by me with a view to saving it from the rapacity of our enemies, to the Church Association of the Utah Stake of Zion In this letter these brethren ask me through you, to consent for the Church Association to appropriate $10,000.00 to pay off some debts already contracted, and to enable them to go on with the work of completing the Stake Tabernacle. I am somewhat surprised at this request, because it is not long since a request for help for this purpose was made by them directly to me, and in ----- new page (MSSSC1946_p071.jpg) reply I made an appropriation of such an amount as I then thought could be spared for that purpose. They also ask for $2,000.00 to be app- ropriated towards the new building for the Academy. It would be cause of regret to us, if in striving to save our property from the proposed spoilation of our enemies, by giving it to the Church Associations in the various Stakes. (Where it legitimately belongs as I understand the Revelations of God concerning the Property tithes of the people H.H.C) a feeling should grow up in those Stakes that now that it is in their hands, it ought to be spent for various uses in the Stakes. We have noticed an inclination of this Kind in some quarters, and if this were allowed to grow the results could not fail to be injurious to the work. No Presidency of a Stake or Bishop of a ward, however, well informed they may be about their local affairs, can be expected to Know the many demands ----- new page (MSSSC1946_p072.jpg) and from the many quarters which are made upon the Trustee in Trust. in connection with the defence of the work and the supplying of its wants at home and abroad. Since this raid commenced it has required the greatest care and watchfulness on the part of the Trustee-in-Trust to control the funds at his disposal in such a manner, as to do that which is absolutely necessary to be done, and at the same time not exhaust the resources at his disposal This latter he could easily do and in a vary short space of time, if he would comply with the suggestions which have been made to him and the dem- ands which have been made made upon him. Every one of experience knows that it is much easier to disburse property than it is to collect it and the Brethren in Utah Stake ought not to think that because there is property there ----- new page (MSSSC1946_p073.jpg) that there are not other uses for it, besides those which press upon them and in the contracting of which the Trustee-in Trust has not been consulted With Kind regards Your Brother John Taylor Saturday 30 This day proves an eventful day in my history. Having stoped all night at the Tabernacle for the purpose of transactig some business at my office which I had fit up in the parlor room of the janitors house I gave notice to President Smoot that I was there as we had some business togeather preparing a letter to Pres Taylor. Pres Smoot and Bp Johnson came in and stoped an hour or more and shortly after they left the United States Marshels 5 in number surrounded the Tabernacle block guarding every avanue and then proceeded to search every nook and corner going under ----- new page (MSSSC1946_p074.jpg) floors into roofs. I had just priviously gone into a closet lately finished for the Tabernacle and close by it. where I rema- ined. After they had gone through the Meeting House from base to the garret and also the Tabernacle and janiter house they visited the closet, which they threatened, to burst open, At this I opened the door and what was wanted had you asked for the door to be opened it would have been without any threats A warrent for my arest was read the charge being "Unlawful coha- bitation" with my wives. Mr Dyke and C N Readfield were the two who arrested me. Readfield with others then hastened to my residences where Emily and Sarah lived but failed to find either of them From there they rushed to the Residence of their parets. I appeared before Commissioner E Hill and waved examination and gave bonds in the sume of $1,500. Bp J.P.R. Johnson and W. C. A. I addressed the congregation in the afternoon the following being a synopsis ----- new page (MSSSC1946_p079.jpg) Monday 2. I established an Office to transact business as Treasurer of the Church Association of Utah Stake in the buil- ding used as Tithing Office. We addressed the following letter to President Taylor. Provo City May 2nd 1887. President John Taylor. Dear Brother: We are in reciept of a copy of a letter from you to Bishop Wm. B. Preston, which we feel demands a response from us, as an explanation in justification of the good intentions which we had in view when we wrote. It now transpires, according to the purport of your letter, that we have undertaken the Construction of two public buildings in this Stake; by which an indebtedness has been incured and concerning which "the Trustee-in-Trust has not been con- sulted". We have been laboring under the impression that you were consulted and if our memory serves us right, every ----- new page (MSSSC1946_p080.jpg) legetimate step, as we supposed, was taken with a view of recognizing you in your position, concerning each of the buildings now under consideration and your hearty sanction was obtained; Altho it is proper in this connection to state that the debts on the Tabernacle and Academy were not con- tracted under your immediate sanction, but you will no doubt readily und- erstand that in the erection of large public buildings by donation, it is difficult to avoid incuring more or less indebtedness; for when in a certain stage of progress an amount of work must be done, in order to protect the walls from damage by storms. So in the case of the Tabernacle: the bulk of the present indebtedness was incurred in placing the roof on the building so as to protect the walls. We had not supposed, in a matter of this character, that it would be necessary, in order to make valid a request, a humble petition, to consult you ----- new page (MSSSC1946_p081.jpg) as to the propriety of incuring a debt under such circumstances. We asumed in a work enjoined upon us of that char- acter, that responsibility and good judg- ement demanded that the protection of the walls should be sustained even if necessary by incurring a debt. Our policy through life has been to avoid indebtedness of every character, but through the public demands that have seemed pressing, unavoidably, upon us we have suffered some debts to occur of a public character, but we feel det- ermined to work these off with the avowed intention of doing only what we have means to pay for in the future. In regard to the Academy we en- deavoured to discharge, faithfully, the duties that the public seemed to dem- and of us. A very lively interest, as you, will remember was manifested for the Academy immediately after the fire throughout the Territory, more especially from those Stakes which ----- new page (MSSSC1946_p082.jpg) had learned of its beneficial results. And upon your own choice of a location for the new building, we incured in its purchase a debt of $2,000,00 a part of which is unpaid to day, and which of course might have been avoided had the location proffered gratuitously by President A.O. Smoot two block further North then the present location, been accepted. We do not refer to this as expressing any disatisfaction of the present site of the Academy. We in good faith and by the liberal interest that you and others then manifested, gave us to believe that we were perfectly safe in going on with the work, the completion of which would be of such unbounded good to the youth of our community, but when you demured to the Stakes outside of our own being called upon for assistance it had such a reactionary effect as to check the interest that was pretty universally manifest, not only in outside Stakes ----- new page (MSSSC1946_p083.jpg) but to some extent in this Stake; hence we found ourselves unsuspectingly in the midst of pushing the work along as rapid- ly as possibly and when we reached a con- dition or stage of the work where we would be justified in closing further opperations we did so and we are also frank and pleased to acknowledge that had you not punct- ually paid up the amount you appropriat- ed we should have been in a very deplorable situation. We can fully sense the position that we have suffered ourselves to be drawn into by a zeal - for the public weal and we can, probably, to some extent at least, realise the many public calls that must inevat- ably devolve upon you and in view of the experence of the past and the growing sentiments among the people concern- ing the expenditure of a certain per cent of the tithing in the Stakes for Stake buildings we are led to express our views on the situation, hoping you will accept them in the same kind feeling ----- new page (MSSSC1946_p084.jpg) in which we wish to be understood as offering them. We believe that a more liberal expendature of the tithing aris- ing in this Stake for Stake purposes, would have a tendency to increase the tithes making it possible for the Stake to send up to Head-quarters its full quota from year to year: for it must be apparent to every one who has had a similar experience to that which we have during the erection of our Tabernacle, in the last few years, that a continual call upon the people for donations for such a public buil- ding, will greatly militate against tithing and lessen the payments proportion- ately; for since you made the remark some years ago to the effect that if the people would pay a full tithing it would not be necessary to call for donations, as we are in the habit of being compelled to now, for the tithing would be ample for all public purposes, a spirit has been growing in accordence with that fact, ----- new page (MSSSC1946_p085.jpg) We are satisfied that you were correct, but it is evident that the people are not paying a full tith, yet many hung on to that theory as an excuse, which certainly militates against the donation system. We certainly believe that if the Church had permitted. this Stake to use from the tithes $40,000,00 instead of $7,500,00 during the four years that the Tabernacle has been in course of erection, that the tithes forwarded to Head-quarters would have equaled the amount which has been sent during that period. In conclusion permit us to express our thanks and appreciation of the sumes you have appropriated to the Tabernacle and the Brigham Young Academy. We do not desire to be understood, "that because there is property" in the hands of the Church Association of this Stake that we are grasping after it, beyond what would be consistant under the present circumstances and about in proportion to help from the Church on the Salt Lake. ----- new page (MSSSC1946_p086.jpg) Assembly Hall; St George Logan and other Stake buildings; but if we have overstep our perogatives in our petitions for an undue portion of the funds arising from the tithes of the people of this Stake for Stake purposes according to that extended to other Stakes then we certainly ask your humble pardon. It may be very proper in this connection ----- new page (MSSSC1946_p100.jpg) to give a brief outlin of the Situation of the Church and the attitude of the government of the United States tow- ards the Latter-day Saints. The Spirit of persicution, from the beginning of this Church, until now has been bitter altho for the first ten years of our exp- erience in these Mountains we were comparitively fee but as the abundent and nutural resurrcis of the County have been developed, the dispoilers have grown ambitions to disposess the the "Mormons" of their hard earned homes, and hence they have resorted to the most wicked subterfuges and flooded the County with the blankest and most o wilful lies in order to excite a bitter hatred and bring down the power of the government upon us. The govermnt therefore have passed oppressive laws and chosen the very bitterest and wicked men to enforce them. With the power of the government to back up a wicked Judiciary the enforcement of the law only upon "Mormon" offenders with ----- new page (MSSSC1946_p101.jpg) packed juries has thrown the territory into a condition similar to the horrors of the Inquisition. The government haves warned the people if they would not renounce polygamy that they should not be admitted as a State and the whole force of the nation would be used to suppress us in these Mountains. A feeling on the part of the President and Some friends among Congressmen to Admit Utah if the people will present a Constitution that forbids polygamy. The people yiald to the dispoiler as the traveller does to the highwaymen with a hope of some day recovering that which has been unjustly forced from them because of the power of the government: All polygamists, therefore, are entierly ignored, in the move towards State- hood and the whole proceedings is from monogamists and must be so rceived as independent from the Church. ----- new page (MSSSC1946_p102.jpg) Sunday 3 I took train to American Fork where I met Pres Smoot, attended meeting dedicated a room for a Prayer Circle and in the evening rode home with Pres Smoot Monday 4.
